    OUR AGE POLICY 

    OUR SERVICES ARE NOT INTENDED FOR INDIVIDUALS UNDER 18 YEARS OF AGE. We do not knowingly solicit or collect any information about or market to children, minors, or anyone under 18 years of age. If we become aware that a child, minor, or anyone under 18 years of age has registered with us and provided us with Personal Information, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If we do delete a profile because a user violated our no children, minors, or anyone under 18 years of age rules, we may retain the user’s email and IP address to ensure that that user does not try to get around our rules by creating a new profile. If you suspect that a user is under 18 years of age, please contact us using the information disposed below in the section entitled “Contact Us” to request the deletion of all such Personal Information. 

    1. WHO IS 2UP DATING & SOCIAL? 

    Play, Match, Chat, Meet. This Policy is issued on behalf of 2up Media LLC, doing business as 2up Dating & Social, a Florida Limited Liability Company, with a goal of connecting gamers from all genres to form meaningful relationships amongst themselves on and off the screen. Users may access our Services by visiting our Website or downloading our free App on the Google Play and/or the Apple Store. Bonus features and perks, such as unlimited swipes, may be accessed through a premium subscription.     2. WHAT INFORMATION DO WE COLLECT? 

    In Short: To achieve our goal of helping gamers come together and form special bonds amongst themselves, we require some information from you, such as basic profile details. We may also collect information generated as you visit or use our Services, such as access logs, or information provided to us by third-parties. All Personal Information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such Personal Information. In this Policy, the term “Personal Information” is used to refer to any information that can uniquely identify an individual, such as yourself. Personal Information may include voluntarily provided information, passively collected information, and information received from others. 

    Voluntarily Provided Personal Information 

    We may collect, use, store and transfer Personal Information that you voluntarily provide to us when you register on or use our Services, express an interest in obtaining information about us or our Services, participate in activities on our Services, or contact us. The Personal Information that we collect depends on the context of your interactions with us, the Services, other users, third-parties, the choices you make, and the products and features you use (such as any contests, games, promotions, quizzes, surveys, research or other services or features). The Personal Information we collect may include the following: 

    • Contact and Registration Information. When you create an account, you provide us with some basic details necessary for the Services to work, such as: your full name; username; email address(es); mobile number; gender identity; date of birth; mailing address; physical address; geographic location; and login information and friend lists of social media accounts that you connect to 2up Dating & Social. You control your user profile and are able to correct or update your information at any time by just logging in to your 2up Dating & Social account.

    • Profile and Sensitive Information. When you set up your profile, you can share additional details on your personality, lifestyle, interests, personal and dating preferences, health and fitness, gameplay content, and other details about you, as well as content such as photos and videos. To add certain content, like pictures or videos, you may allow us to access your camera or photo album. If you need to update your permissions, you can do so in the “Settings” app of your device. We may also collect information about the content, such as the time, date, and place the photo or content was taken or uploaded (also known as metadata), and how you use them, who views them or with whom you share them. Additionally, we may scan, monitor, store and analyze the photos, videos and other content you provide to us using third-party services for several purposes, including for anti-fraud purposes, for the assessment of whether the photos are consistent with our Terms of Use, to help identify your interests and activities, and to help us provide better matches for you. You may also choose to provide more “sensitive” information (for example, your racial or ethnic origins, sexual orientation, disability, religious beliefs, and union membership).

    • Financial Information. When you subscribe to a paid service or make a purchase directly from us (rather than through a platform such as iOS or Android), you provide us or our payment processor with information, such as your debit or credit card number or other financial information.     • Service and Features Information. When you participate in surveys or focus groups, you give us your insights into our Services and features through your responses to our questions and testimonials. When you choose to participate in our promotions, events or contests, we collect the information that you use to register or enter. We may collect the information shared with others through public profiles or private messages. We may collect information from your visits, usage, and navigation of the in-app games.

    • Direct Communication with 2up Dating & Social Information. If you contact our customer care team, we collect the information you give us during the interaction. We also collect comments that you post on the pages we have on a third-party service, such as our Instagram and Facebook pages and messages that you send us directly through those services. Additionally, we may collect and analyze any comments, photos, messages or other content or communications you and other users share on our Services or send to each other, including through in-app messages, chat or other functionalities. We may monitor or record these interactions for training purposes and to ensure a high quality of service.


    When you post information about yourself or use the messaging function, the amount of personal and sensitive information you share is at your own risk. When using 2up Dating & Social, you should assume that anything you post or submit on the App may be publicly-viewable and accessible, both by Users and non-Users of the App. Therefore, we recommend and encourage you (and all our users) to think carefully about the information you disclose about yourself. We also do not recommend that you put email addresses, URLs, instant messaging details, phone numbers, full names or addresses, credit card details, national identity numbers, drivers’ license details, and other sensitive information on your profile which is open to abuse and misuse. We want our 2up Dating & Social users to be careful about posting information that could eventually be made public. If you post anything that is inconsistent with our Terms of Use, we reserve the right to terminate your Account.     Information Passively Collected Through The Use Of Our Services 

    In addition to the information you voluntarily provide to us directly, we automatically collect certain information when you visit, use, or navigate our Services. For instance, at least some of such passively collected information may be collected through the use of cookies.

    • Information on Use of Our Services. When you access our Services, we automatically collect information about your activity, for instance how you use them (e.g., date and time you logged in, duration of visit, features you’ve been using, browsing and search history, clicks and pages which have been shown to you, referring webpage address, advertising that you click on, crash logs, dating insights, purchase history, music listening data) and how you interact with other users (e.g., users you connect and interact with, time and date of your exchanges, number of messages you send and receive, other friends or contacts you invite to the Services and profile searches you perform or your use of our applications).

    • Information on Device(s). When you access our Services, we automatically collect information from and about the device(s) you use to access our Services. This information does not reveal your specific identity (like your name or contact information), but may include device and usage information, such as:

      hardware and software information such as Internet Protocol (IP) address (or proxy server), your wireless and mobile network connection, like your service provider and signal strength, the site from which you came and the site to which you are going when you leave our website, your mobile device’s ID, type, and manufacturer, your mobile device’s operating system or platform, device-specific and apps settings and characteristics, app crashes, advertising IDs (such as Google’s AAID and Apple's IDFA, both of which are randomly generated numbers that you can reset by going into your device’ settings), browser type, version and language, operating system, time zones, country information, identifiers associated with cookies or other technologies that may uniquely identify your device or browser (e.g., IMEI/UDID and MAC address). 

    • Other Information Collected With Your Consent. We may collect your precise geolocation (latitude and longitude) through various means, depending on the service and device you’re using, including GPS, Bluetooth or Wi-Fi connections, with your consent. We request permission to access and track such location-based information from your mobile device, either continuously in the background or while you are using our Services, to provide certain location-based services. If you consent, we may collect your photos and videos (for instance, if you want to publish a photo, video, or streaming on our Services). If you wish to change our access or permissions, you may do so at any time in your device’s settings:

      Our Services use Google Maps APIs, which is subject to Google's Terms of Service. You may find the Google Maps APIs Terms of Service https://cloud.google.com/maps-platform/terms/. We use the Google Maps API to retrieve certain information when you make location-specific requests. If you wish to change our access or permissions, you may do so at any time in your device’s settings. The Maps APIs that we use store and access cookies and other information on your devices. 

      We may request to send you push notifications regarding your account or certain features of our App. If you wish to opt-out from receiving these types of communications, you may turn them off in your device's settings.

    This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes. Like many businesses, we also collect information through cookies and similar technologies. Please refer to the section below entitled “DO WE USE COOKIES AND OTHER SIMILAR TRACKING TECHNOLOGIES?”. 


    Information Received From Others 

    In order to enhance our ability to provide relevant marketing, offers, and services to you and update our records, we may obtain information about you from other sources, such as other users, public databases, joint marketing partners, affiliate programs, data providers, social media platforms, as well as from other third-parties. This information includes mailing addresses, job titles, email addresses, phone numbers, intent data (or user behavior data), Internet Protocol (IP) addresses, social media profiles, social media URLs and custom profiles, for purposes of targeted advertising and event promotion. 

    • Social Media. If you interact with us on a social media platform using your social media account (e.g. Facebook or Instagram), we receive information about you such as your name, email address, and gender. Any information that we collect from your social media account depends on your social media account's privacy settings.

      Our Services offer you the ability to register and login using your third-party social media account details (like your Facebook or Twitter logins). Where you choose to do this, you permit us to access and use certain information about you that is made available to us through or from that social media platform. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, profile picture as well as other information you choose to make public on such social media platform. 

      We will use the information we receive only for the purposes that are described in this Policy or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their Policy to understand how they collect, use and share your personal information, and how you can set your privacy preferences on their services. 

    • Other Users, Third-Parties, and Partners. Other users may provide information about you as they use our Services. For instance, we may collect information about you from other users if they contact us about you. We may receive information about you from our partners, for instance where 2up Dating & Social ads are published on a partner’s websites and platforms (in which case they may pass along details on a campaign’s success).

    3. HOW DO WE USE THE COLLECTED INFORMATION? 

    In Short: The main reason we process your information is to perform our Services and where we have legitimate interests to do so. For instance, we process your information to administer your account, deliver, and improve our Services, including maintaining the safety of our users and providing advertising tailored to the interest of our users, to maintain the security and operation of our Services, and comply with applicable laws. 

    To Administer Your Account and Make Our Services More Easily Available To You. We use the collected information to create and manage your account and profile, provide your with customer support, and communicate with you about product personalization (such as a list of recommended products, services, posts, or suggestions), including providing ads, offers, sweepstakes, contests, and specials relevant to you. We also use the collected information to complete your transactions and keep a history of your purchases. Additionally, we use the collected information to analyze your use of our Services to better develop, display, and track content and advertising tailored to your interests, including helping games come together to form special bonds amongst themselves. 

    To Improve Our Services, Protect Our Users, and Comply With Applicable Laws. We use the collected information to conduct research and analysis of users’ behavior, and administer focus groups and surveys, to understand the effectiveness of existing product features, improve our Services and content, and develop new features and services. We also use the collected information to prevent, detect, and combat fraud or other illegal or unauthorized activities, such as addressing ongoing or alleged misbehavior on and off-platform and retaining data related to fraudulent activities to prevent recurrences and design countermeasures.     4. HOW DO WE SHARE THE COLLECTED INFORMATION? 

    In Short: We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations. 

    With Other Users. You share information with other users when you voluntarily disclose information on our Services. When you post information about yourself or use the messaging function, the amount of information you share is at your own risk. After information has been shared, we are unable to control what others do with such information. You can control your profile and who views it at any time by just logging in to 2up Dating & Social. 

    With Our Service Providers and Partners. We use third-parties to help us operate and improve our Services, such as Stripe.com, available at: https://stripe.com/privacy, and Google Maps API, available at: https://cloud.google.com/maps-platform/terms/. These third-parties assist us with various tasks, including data hosting and maintenance, analytics, customer care, marketing, advertising, payment processing, and security operations. 

    For Corporate Transactions. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, acquisition of all or a portion of our business to another company, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control. 

    To Fulfill Our Terms of Use and Achieve Our Legitimate Business Interests. Where you use our Services, we may process your personal information to fulfill our Terms of Use. We may process your data when it is reasonably necessary to achieve our legitimate business interests.

    When Required By Law and To Enforce Legal Rights. We may disclose your information if reasonably necessary to comply with applicable law, governmental requests, the legal process, such as a court order, subpoena or search warrant, government / law enforcement investigation, a judicial proceeding, or other legal requirements; to assist in the prevention or detection of crime (subject in each case to applicable law); to protect the safety of any person; to mitigate our liability in an actual or threatened lawsuit; to protect our legal rights and legal rights of our users, business partners or other interested parties; to enforce our agreements with you; and to investigate, prevent, or take other action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, as evidence in litigation in which we are involved, or other wrongdoing. 

    With Your Consent. We may process your data if you have given us specific consent to use your personal and non-personal information in a specific purpose. We may ask for your consent to share your information with third-parties to offer you certain products, services, advertising or promotions. In any such case, we will make it clear why we want to share the information. 

    Offer Wall. Our App may display a third-party hosted “offer wall.” Such an offer wall allows third-party advertisers to offer virtual currency, gifts, or other items to users in return for the acceptance and completion of an advertisement offer. Such an offer wall may appear in our App and be displayed to you based on certain data, such as your geographic area or demographic information. When you click on an offer wall, you will be brought to an external website belonging to other persons and will leave our App. A unique identifier, such as your user ID, will be shared with the offer wall provider in order to prevent fraud and properly credit your account with the relevant reward. Please note that we do not control third-party websites and have no responsibility in relation to the content of such websites. The inclusion of a link towards a third-party website does not imply an endorsement by us of such website. Accordingly, we do not make any warranty regarding such third-party websites and we will not be liable for any loss or damage caused by the use of such websites. In addition, when you access any third-party website, please understand that your rights while accessing and using those websites will be governed by the privacy notice and terms of service relating to the use of those websites. 

    5. DO WE USE COOKIES AND OTHER SIMILAR TRACKING TECHNOLOGIES? 

    In Short: We may use cookies and other tracking technologies to collect and store your information. 

    We use and may allow others to use cookies and similar technologies (e.g., web beacons, pixels) to recognize you and/or your device(s). Cookies are small data files that are transferred to your computer's hard disk and are basically a tool that stores information about website visits, recognizes you and your preferences each time you visit 2up Dating & Social, and ensures site functionality and enables us to provide the services our users’ request. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. 

    Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Policy. 

    6. WHAT IS OUR STANCE ON THIRD-PARTY WEBSITES? 

    In Short: We are not responsible for the safety of any information that you share with third-party providers who advertise, but are not affiliated with, our Services. 

    Our Services may contain advertisements from third-parties that are not affiliated with us and which may link to other websites, online services or mobile applications. We cannot guarantee the safety and privacy of data you provide to any third-parties. Any data collected by third-parties is not covered by this Policy. We are not responsible for the content or privacy and security practices and policies of any third-parties, including other websites, services or applications that may be linked to or from our Services. You should review the policies of such third-parties and contact them directly to respond to your questions. 

    7. HOW DO WE KEEP YOUR INFORMATION SAFE? 

    In Short: We aim to protect your Personal Information through a system of organizational and technical security measures. 

    We have implemented appropriate technical and organizational security measures designed to protect the security of any Personal Information we process, including unauthorized access to or alteration, disclosure or destruction of your Personal Information. We regularly monitor our systems for possible vulnerabilities and attacks and regularly review our information collection, storage, and processing practices to update our physical, technical and organizational security measures. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security, and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of Personal Information to and from our Services is at your own risk. You should only access the Services within a secure environment. 

    We may suspend your use of all or part of our Services without notice if we suspect or detect any breach of security. If you believe that your account or information is no longer secure, please notify us immediately using the information disposed below in the section entitled “Contact Us”. If you ever think someone has had access to your social media password, please report it to the relevant social media platform and change your password immediately. We cannot guarantee the security of your personal data while it is being transmitted to our site and any transmission is at your own risk. 

    8. HOW LONG DO WE KEEP YOUR INFORMATION? 

    In Short: We keep your Personal Information for as long as necessary to fulfill the purposes outlined in this Policy unless otherwise required by law. 

    We will only keep your Personal Information for as long as it is necessary for the purposes set out in this Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, legitimate business interest, or other legal requirements). Generally speaking, your Personal Information will not be retained once you delete your account and cease to use our Services. 

    However, to protect the safety and security of our users on and off our Services, we implement a reasonable safety retention window of following account deletion. During this period, certain Personal Information will be retained although the account will of course not be visible on our Services anymore. When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize such information, upon deletion of your account (following the safety retention window) or within reasonable time after of continuous inactivity, unless a longer retention period is required or permitted by law. If this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible. 

    Keep in mind that even though our systems are designed to carry out data deletion processes according to the above guidelines, we cannot promise that all data will be deleted within a specific timeframe due to technical constraints. 

    9. WHAT ARE YOUR PRIVACY RIGHTS? 

    In Short: You may review, change, or terminate your account at any time. 

    Depending on your state of residency, you may have certain data protection rights. However, every user of our Services is entitled to the following rights: 

    The Right to Access. You have the right to request copies of the Personal Information we have collected. We may charge you a small fee for this service. 

    The Right to Rectification. You have the right to request us to correct any Personal Information we have collected that you believe to be inaccurate. You also have the right to request we complete Personal Information you deem incomplete. 

    The Right to Deletion. You have the right to request us to delete your Personal Information, under certain conditions. 

    The Right to Restrict Processing. You have the right to restrict the processing of your Personal Information, under certain conditions. 

    The Right to Object to Processing. You have the right to object to our processing of your Personal Information under certain conditions. Additionally, you may have the right to object to our processing of your Personal Information regarding information passively collected through the use of our Services. 

    The Right to Data Portability. You have the right to request that we transfer the Personal Information we collect to another organization or directly to you, under certain conditions. 

    The Limited Right of Private Action. In the event we fail to implement and maintain the reasonable security procedures and practices outlined in this Policy, and such failure directly leads to the unauthorized access and exfiltration, theft, or disclosure of your Personal Information, you have the right to bring a civil action against us, provided we are given thirty (30) days to cure the violation and notify you of such cure. 

    Exercising Your Data Privacy Rights. You may exercise any of the rights discussed above by contacting us at the information disposed below in the section entitled “Contact Us.” We will do our best to timely process all such requests within forty-five (45) days. Please note we may require an extended time period of an additional forty-five (45) days to process any such request; however, we will provide you with notice of such extended time period and the reason for our delay.

    Device Permissions. Mobile platforms have permission systems for specific types of device data and notifications, such as phone book and location services as well as push notifications. You can change your settings on your device to either consent or oppose the collection of the corresponding information or the display of the corresponding notifications. Of course, if you do that, certain services may lose full functionality. 

    Cookies and Similar Technologies. Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. To opt-out of interest-based advertising by advertisers on our Services visit http://www.aboutads.info/choices/. 

    Opting Out of Email Marketing. You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the information disposed below in the section entitled “Contact Us”. You will then be removed from the marketing email list – however, we may still communicate with you, for example to send you service-related emails that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes. If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority.     • You have the right to request that we delete your personal information that we collected from you, subject to certain exceptions.

      California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.     As 2up Dating & Social evolves, we retain the discretion to revise this Policy from time to time. The updated version will be indicated by an updated “Revised” date and the updated version will be effective as soon as it is accessible. If we make changes to this Policy that, in our sole discretion, is material, we may notify you either by prominently posting a notice of such changes on 2up Dating & Social or by directly sending you a notification.
